Second Opinion

Because first advice isn’t always final advice

Being told you don’t have a claim can feel like a door closing, but it isn’t always the last word. We have a strong track record of taking on, and winning, cases other solicitors have turned away. If you’re unsure about the advice you’ve received, a second opinion could shed new light on what really happened to you or your loved one.

Reasons to reach out for a second opinion

It might be a feeling that something wasn’t fully explored, or a sense that parts of the story never quite added up. Perhaps a new medical opinion has changed your outlook on what happened, or you’ve come to regret a decision made under pressure. Whatever brought you here, it’s always worth asking again, for your own peace of mind, and to make sure you’re doing the right thing for yourself and your loved ones.

What happens when you speak to us?

A no-obligation conversation

Speak to our team about your journey to this point. We’re good listeners.

We review independently

We’ll take a look at your records, your previous advice, and use our own trusted medical experts to understand if you might have a case.

We explain your options

Honestly, including how it would be funded, in plain terms.

You decide

There’s no pressure to proceed, at any point.

How long do you have to bring a claim?

If you’re considering a second opinion, it’s best not to leave it too long. Medical negligence claims are subject to strict time limits, and missing them can mean losing the right to pursue a claim at all — although timeframes are longer for children or anyone who lacks full mental capacity. Even if your case has already been closed, it may still be possible to reopen it, as long as time hasn’t run out.

Easy-to-understand funding, however complex it gets

Our second opinion is always free, with no obligation to proceed. If we take on your case, we work on a no win, no fee basis for most claims, so there’s no upfront cost, and nothing to pay if it isn’t successful. For claims involving a brain injury or significant harm, we go further still, with no success fee at all, so your compensation can be used to the full, exactly as intended.

Why CL Medilaw?

We’ve taken on, and won, many cases where clients were told by other solicitors that they didn’t have a case. Sometimes a fresh pair of eyes see things differently, especially with the right specialist expertise. We’re accredited by the Law Society, AvMA, APIL and the Brain Injury Group, and our medical negligence team has been practising since the 1990s, with many of the people working on cases today still here, and still changing lives for the better.

FAQs about second opinions

In most cases, you have three years from the date of the negligence, or from the date you first became aware of it, to start a claim. Time limits are longer for children and for anyone who lacks full mental capacity.

No, we can review your case over the phone, by video call, or in person; whichever works best for you. If you want to meet us but are unable to travel, just let us know so we can plan a home visit instead.

A full second opinion typically takes up to four weeks to complete, as our team and medical experts need time to properly review your records.

You don’t need to gather anything yourself. We’ll ask you to sign a form of authority (a simple written consent form) which allows us to legally request your complete medical records directly from your GP, hospitals, or other healthcare providers on your behalf.

Yes, it’s better to be upfront about who’s advised you before, and any reports you’ve already received. This doesn’t put us off taking on your case; if anything, it helps us understand exactly what’s already been explored, and where a fresh look might make a real difference.
