The child has since been diagnosed with cerebral palsy.
• Securing judgment on behalf of a young adult who sustained a brain injury at birth when syntocinon was given to the mother to expedite delivery despite that the CTG trace showed that the baby was in considerable distress already, but there was a failure to recognise this, causing cerebral palsy. This was another successful “second opinion” investigation after the initial expert evidence obtained by the previous firm didn’t support a claim.
• Obtaining seven-figure compensation for a family who were not advised during pregnancy that their baby would be born with severe disabilities caused by a rare genetic condition.
• Recovering seven-figure compensation on behalf of the estate of a husband and father following a failure to identify that he was at risk of suffering a cardiac arrest, leading to his premature death.

• Kay successfully concluded a claim for an adult with severe dyskinetic cerebral palsy (GMFCS Level V), whose case had been previously investigated and abandoned by another firm during childhood. The claimant, now in her twenties and fully dependent on her parents, sought Kay’s specialist expertise. Kay advanced the claim on the basis that the CTG trace during labour had been misinterpreted, despite clear signs of fatal compromise and a deteriorating condition. Expert evidence confirmed that timely delivery would have prevented some or all of the brain injury sustained at birth. Stella provides comprehensive advice and support in relation to Court of Protection and private client matters, helping clients and their families plan for the future and manage complex financial and legal affairs with confidence. Stella advises on the creation of lasting powers of attorney, the management of financial affairs, long-term investment planning, the establishment and administration of trusts (including personal injury trusts), the drafting of wills, lifetime tax planning strategies and eligibility for assistance with care costs through local authority funding, NHS Continuing Healthcare and state benefits.
