Gail Waller, solicitor in Brighton

Gail Waller

Partner

About me

Gail is a Partner specialising in Clinical Negligence cases.

Gail specialises in complex claims arising from failures in maternity care including footling breech deliveries, shoulder dystocia, cerebral palsy and stillbirth. She works with deputies and case managers to manage multi-million-pound settlements and to support clients who lack capacity to ensure their future needs are met. In addition, Gail has specialist expertise in Coroner’s inquests concerning deaths arising from suspected clinical failings.

Gail has a particular reputation for client care, understanding that litigation can be a difficult process for people and that the professional relationship she builds with her clients is as important as the legal advice she provides.

She is a member of the Association of Personal Injury Lawyers (APIL) and a trustee for Andy’s Angels, a local charity supporting families and children through their grief journey.

Gail’s case highlights include:

  • Representing a couple at the inquest into the death of their baby. Antenatal appointments had failed to identify that the baby was in a breech position and he sustained catastrophic injuries during a planned homebirth. Gail obtained compensation for the parents but, more importantly, changes were made to save the lives of other babies. The local NHS Trust introduced presentation scans at 38 weeks for all planned homebirths and the national ambulance guidance was updated to ensure that any woman with a footling breech delivery was immediately transferred to hospital.
  • Successfully negotiated settlement of a claim for a child with severe cerebral palsy following hypoxia at birth. The claim included sums for accommodation, care, case management and therapies. The damages of £7 million made a significant difference in the quality of life of the child and her family.

Other praise for Gail from clients include:

“Gail was so professional, personable, experienced and knowledgeable – from day one we felt in safe hands. Gail always replied to my emails promptly and kept me in the loop at all times. It’s easy to find a solicitor, but not easy to find one who truly cares and shows real sensitivity. Thank you so much Gail and team.”

“Gail Waller was tenacious in following up and winning substantial compensation in my medical negligence case. Highest degree of professionalism, excellent advice, and clear, explanation of issue and costs. I have been very impressed with all aspects of the service provided.”

“I cannot fault the care and attention given by Gail Waller during the difficult time from my son’s death to his inquest. She was unceasingly helpful, professional and supportive.”

Jenny Clendining

Partner

About me

Jenny is Partner specialising in Clinical Negligence cases.

Jenny has extensive experience in complex clinical negligence claims on behalf of adults and children, with a recognised specialism in cerebral palsy and obstetric negligence claims.

Jenny’s practice focuses on supporting families in cases where children have sustained serious injuries, most commonly neurological injuries, including cerebral palsy, arising around the time of birth. These cases frequently involve the mismanagement of pregnancy, delays in delivery during labour or inadequate care during the neonatal period. Jenny has successfully secured multi-million-pound, life-changing settlements against a number of hospital trusts, including claims brought against Shrewsbury and Telford NHS Trust following the maternity services scandal.

In addition to her maternity-related work, Jenny brings a depth of experience to complex clinical negligence claims arising from failures to diagnose and treat cancer. She also represents families in fatal claims, acting on behalf of those who have lost loved ones as a result of substandard medical care and provides considered, compassionate support throughout the claims process.

Jenny’s case highlights include:

  • Securing a settlement comprising a substantial lump sum and annual periodical payments for life, with a total capitalised value in excess of £22 million, for a girl who sustained a birth injury as a result of negligent delays in delivery. In addition, a series of interim payments were obtained during the course of the claim – to enable the family to move to more suitable accommodation and to access appropriate educational provision and essential support services.
  • Obtaining settlement of over £18 million pounds, which included a lump sum and annual payments for life, on behalf of a little girl who suffered cerebral palsy due to the mismanagement of her mother’s labour, resulting in her being deprived of oxygen at birth.
  • Obtaining a multi-million-pound settlement for a boy who at 4 years old had suffered a significant delay in diagnosis and treating communicating hydrocephalus, which resulted in the little boy obtaining permanent brain damage.

Jonathan Phillips

Partner

About me

Jonathan is a Partner specialising in Clinical Negligence cases.

Jonathan advises clients and their families who have suffered catastrophic injury or loss as a result of failures in medical care. He has a particular expertise in brain injury claims, including cases involving children with cerebral palsy caused by brain damage sustained at birth. He also specialises in “wrongful birth” claims, inquests and claims arising from the death of a loved one while under the care of medical professionals.

Jonathan is also a member of the Action against Medical Accidents (AvMA) specialist clinical negligence panel.

Jonathan’s case highlights include:

  • Securing judgment on behalf of a 26 year old man who sustained a brain injury at birth when there was a failure to interpret the CTG trace as showing signs that he was in distress, causing cerebral palsy (PVL). The case settled on the afternoon before an eight day trial was due to start at the High Court. This was a successful “second opinion” investigation after the family had been advised almost 20 years previously by another firm that there was insufficient evidence to be successful.
  • Securing judgment on behalf of a young girl who sustained a brain injury at birth after the staff at the local midwifery led unit failed to identify that the baby was in the “brow face” position, and urgent transfer to hospital was required for delivery. The child has since been diagnosed with cerebral palsy.
  • Securing judgment on behalf of a young adult who sustained a brain injury at birth when syntocinon was given to the mother to expedite delivery despite that the CTG trace showed that the baby was in considerable distress already, but there was a failure to recognise this, causing cerebral palsy. This was another successful “second opinion” investigation after the initial expert evidence obtained by the previous firm didn’t support a claim.
  • Obtaining seven-figure compensation for a family who were not advised during pregnancy that their baby would be born with severe disabilities caused by a rare genetic condition.
  • Recovering seven-figure compensation on behalf of the estate of a husband and father following a failure to identify that he was at risk of suffering a cardiac arrest, leading to his premature death.

Praise for Jonathan from clients include:

“I am especially grateful to Jonathan Phillips and his assistants for their dedication and hard work. Jonathan worked on my case for six years with incredible skill, professionalism and determination. Together we went through countless documents and overcame many challenges. There were times when I lost patience and confidence but Jonathan always encouraged me to keep going and never give up. Thanks to his experience, persistence and support, we finally won the case. I cannot thank Jonathan and his assistants enough for everything they did. Their commitment and hard work made all the difference and I will always be deeply grateful.”

Kay Taylor - medical negligence solicitor Birmingham

Kay Taylor

Managing Director

About me

Kay is the Managing Director of CL Medilaw and a Law Society‑accredited clinical negligence specialist. She has particular expertise in cases involving substandard maternity care and is a strong advocate for early intervention for children with brain injuries, as well as for the prompt acknowledgment of errors within the NHS.

A long‑standing trustee of The Pace Centre in Aylesbury, she is committed to ensuring children with neurodisabilities receive early, specialist therapy. She also works closely with a number of charities supporting individuals and families with complex needs.

Kay represents families across England and Wales in claims arising from injuries sustained during pregnancy, labour, delivery or neonatal care, including cases where children have developed cerebral palsy. Her practice also includes complex paediatric claims, such as failures to diagnose and treat meningitis.

She plays a key role in leading the firm’s national team and its extensive obstetric litigation practice.

Kay’s case highlights include:

  • Securing compensation for a teenager with mixed dyskinetic-spastic cerebral palsy who is wheelchair-dependent, has reduced cognitive abilities and requires 24-hour care. She led a team of lawyers representing the family and adopted a fresh strategy after a previous firm had abandoned the claim following its initial investigation;
  • Kay secured substantial compensation for a child with spastic quadriplegic cerebral palsy and global developmental delay caused by periventricular leukomalacia. The claim arose from the hospital Trust’s failure to carry out regular CTG monitoring or correctly interpret concerning symptoms such as headaches, blurred vision and ankle oedema, linked to high blood pressure. The Trust admitted that proper monitoring would have prompted an earlier delivery and prevented the brain injury. As the child will require lifelong care and support, the early admission of liability enabled immediate access to essential accommodation, care and mobility aids. The final settlement provided long‑term financial security for the child and his family;
  • Kay successfully concluded a claim for an adult with severe dyskinetic cerebral palsy (GMFCS Level V), whose case had been previously investigated and abandoned by another firm during childhood. The claimant, now in her twenties and fully dependent on her parents, sought Kay’s specialist expertise. Kay advanced the claim on the basis that the CTG trace during labour had been misinterpreted, despite clear signs of fatal compromise and a deteriorating condition. Expert evidence confirmed that timely delivery would have prevented some or all of the brain injury sustained at birth. The settlement enabled the claimant and her mother to secure suitably adapted accommodation, external care, therapies and specialist equipment, significantly improving her quality of life and long‑term wellbeing.

Praise for Kay from clients include:

“Any questions or worries we have, are always answered in depth and in such a friendly manner with nothing being too much trouble. We can now move forward as a family with having peace of mind that our son will be thoroughly cared for the rest of his life.”

“She guided me through what was, at the time, quite a rollercoaster of a journey and I can only add that anyone who is faced with a similar situation, or worse, would be very fortunate to be represented by Kay.”

“She kept me fully informed throughout, with charm and good humour… I was so impressed with Kay that when she moved firms, I was concerned to retain her excellent services and support and so kept my case with her.”

  • Achieving a £5.5 million settlement (AD v CF) on behalf of a minor who sustained severe brain injury while competing in power boating, involving multiple defendants, an unincorporated association and its regulatory body;

  • Obtaining a £3.3 million settlement for a motorcyclist who sustained catastrophic orthopaedic injuries, comprising a lump sum and periodical payments of £125,000 per annum, to meet lifelong care, rehabilitation, accommodation and loss of earnings needs.

Laura Cook

Partner

About me

Laura is a long-standing Partner in the team, specialising in birth injury and maternity claims.

Laura specialises in cerebral palsy and obstetric negligence claims and has extensive experience acting for children who have sustained brain injuries at birth or during the neonatal period as a result of negligent management of pregnancy, labour, delivery or postnatal care. She has extensive experience in conducting cases involving hypoxic ischaemic encephalopathy (HIE) and periventricular leukomalacia (PVL) at birth, leaving children with significant life-long disabilities.

Many of Laura’s cases involve complex medical and evidential issues, and she works with leading medical experts in the field to establish liability even in the most difficult of cases. She is frequently instructed on birth injury matters that have been declined or discontinued by other solicitors, applying detailed and thorough investigation to uncover negligence and ultimately achieve successful outcomes and substantial compensation for her clients.

Laura is the lead supervisor for cerebral palsy and birth injury claims across our national team.

Laura is an accredited panel member of Action against Medical Accidents (AvMA).

Laura’s case highlights include:

  • Securing a lump sum of £8 million, together with annual periodical payments of £450,000 for life, for a young girl who sustained PVL injury at birth due to hospital failures in her delivery, in a case where other solicitors had discontinued for lack of merit.
  • Achieving a multi-million-pound settlement for a young boy who suffered profound brain damage following negligent delays in delivery after his mother experienced a uterine rupture during labour.
  • Recovering a seven figure lump sum plus annual payments for care for a young man who suffered a brain injury due to the death of his identical twin during their mother’s pregnancy when twin to twin transfusion syndrome ‘TTTS’ arose, alleging failures in antenatal scanning and failure to deliver the twins before the injury occurred.

Praise for Laura from clients include:

“In our initial discussion with Laura we were immediately impressed with not only her knowledge and professionalism but also her compassion during what was a very difficult time for all our family. In our dealings with Laura over a two-year period we viewed her as a friend who has been totally supportive, whilst also dealing with our claim in a very professional manner. We cannot praise her enough and would certainly recommend the team to anyone.”

“I just wanted to convey my sincere personal thanks to you for all your hard work, skill and attention to detail, in overseeing our case. We really appreciate everything you’ve done for us – you’ve always been on our side, always tried to pursue the things we most cared about, and always handled everything with great sensitivity and kindness. Its testament to your professionalism that we now appear to have secured a settlement with the Trust and brought things to a successful conclusion.”

“When the other law firm, which we had approached first, did not see any merit in our case, and neither investigated my daughter’s case properly, your firm took up this challenging case and instructed experienced experts and counsel and having that medical knowledge, asked the right questions and, more importantly, listened to us. We were never listened to or heard properly by the previous solicitors. You have listened to us, investigated the case in detail, and approached it differently. You are the most committed and compassionate of lawyers I have come across.”

Praise from Matthew’s clients includes:

“My brother and I first met Matthew after we had been given some horrific news. My brother was terminally ill as a result of medical negligence years previous. As a family we were at the lowest ebb of our lives and a friend had advised us to contact CL Medilaw to see if they could assist us in any way. That advice would be the best we could have received. From the outset I was impressed by Matthew’s professionalism and how at ease he made my brother feel. You could tell immediately that he was the person you wanted to fight your corner, a consummate professional who knows his trade implicitly. He had a wonderful caring manner in which he asked his questions, and you could see that he genuinely cared for our situation. Throughout the process he was magnificent, always taking the time to answer any questions we had, or to keep us updated on any movements. He showed great compassion towards my sister-in-law and our family, and I couldn’t sing his praises any higher.”

“Matthew’s performance literally changed our lives, nothing will ever bring my brother back, but Matthew’s actions have made my brother’s wife and children’s lives so much easier now they no longer have to worry financially. I thank Matthew from the bottom of my heart, and I would recommend him in a heartbeat to anyone who finds themselves in the dreadful position we did.”
