In October 2018, TB first presented to a GP at their surgery with a cracked heel on his left foot and was advised to moisturise.

On 19th October 2018, TB was seen by his GP who planned to conduct HBA1C blood tests in order to detect diabetes.

On 2nd November, TB was referred to Podiatry. On 9th November, TB saw a podiatrist and it was noted that TB could only walk 50 yards before he suffered cramps in the left thigh. TB was urgently referred to the Vascular Surgeons. A month later TB saw a Dr who noted that TB had still not seen the Vascular surgeon. TB continued to be treated by the GP in the meantime and a HBA1C test confirmed that he was suffering from type 2 diabetes.

On 4th January 2019, TB attended a vascular surgical appointment, and a diagnosis of left foot gangrene was made. Advice was given to TB that best treatment option was for left below the knee amputation which proceeded three days later.

On 9th January 2019, whilst in hospital, TB suffered a transient episode of incomprehensive speech and left sided facial droop. On 27th March 2019 TB required amputation of the right leg, below the knee and also suffered a stroke.

What went wrong?

The Podiatrist failed to refer TB to vascular surgeons on an urgent basis, due to an administration error.  The Defendant accepted that with earlier referral to vascular surgeons, TB would have received treatment sooner and the left leg would not have required amputation.

It was accepted that the sadly TB would have suffered from a stroke and right leg amputation, in any event.

What we did?

We obtained expert evidence from medical professionals who reviewed the treatment which TB received which enabled allegations of negligence to be raised with the Defendant.  Consequently, the Defendant accepted their failings and further medical evidence was obtained aimed at being able to put in place aids and equipment aimed at making life easier for TB, such as the additional care, cost of prosthetic limbs and other additional expenses, such as adaptive holiday accommodation.

Changing Lives:

We successfully concluded the case for TB and his family who, as a result, will be able to go on holiday with his children and grandchildren and receive all the care he requires.

TB thanked CL Medilaw for their assistance and support and provided a special mention to Andrew Cragg for all his input throughout.
